RULES OF THE PROMOTION

“YOUR BIG SUMMER PLAN”


The trading company UNILEVER ESPAÑA, S.A., with registered office at calle Tecnología, no. 19, 08840 Viladecans, in Barcelona and with Tax Identification Number (NIF) A-28660520 (hereinafter, UNILEVER or the Promoter), states that it shall carry out a promotion called “Your big summer plan”.

The products subject to the promotion (hereinafter, “promoted product” or “promoted products”), shall be:

1. SCOPE

The promotion shall take place in Spain, excluding the Islands, Ceuta and Melilla.


2. DURATION


The period for buying the promoted product shall last from 00:00 on 01/05/2024 until 23:59 on 30/11/2024, Spanish mainland time (hereinafter, the “promotional period”).

The period for taking part by registering the receipt on the promotional website shall last from 00:00 on 01/05/2024 until 23:59 on 30/11/2024, Spanish mainland time (hereinafter, the “registration period”).

The period for using the gift shall last from 00:00 on 01/05/2024 until 23:59 on 30/05/2025, Spanish mainland time (hereinafter, the “use period”).


3. PARTICIPANTS


Any natural persons aged 18 years or over, who buy at least one (1) of the promoted products and meet all the requirements established in these terms and conditions may take part in the promotion (hereinafter, the “Participant” or the “Participants”).

Any employees of the Organising Company or affiliated companies, advertising agencies, or collaborating companies of this Promotion shall not be allowed to take part. First-degree relatives of any of the aforementioned shall not be allowed to take part either.


4. COMMUNICATION


This promotion shall be communicated by means of promotional posters at the point of sale, UNILEVER digital communication, via social media and also on the promotional website.


5. REGISTRATION MECHANICS


Any person entitled to take part in accordance with section 3, who correctly complies with the following mechanics shall be considered a

 

1.    Buy at least one (1) unit of any promoted product stated in section 1 during the promotional period.

 

2.    Visit the promotional website www.tuplanazo.com during the entry period and fill in the registration form, providing the following information:

 

a)   Name.

b)   Surname(s).

c)   E-mail address.

d)   Repeat e-mail address.

e)   Image of the receipt, invoice or legal proof of purchase in PDF, JPG or PNG format which is smaller than 10 MB in size, where detail of the promoted product purchased can be seen clearly, as well as the price, date and time of purchase, the establishment and the receipt, invoice or proof of purchase number.

 

Each receipt may only be used one (1) time and it shall give the right to one (1) experience on Rewards For All, irrespective of the number of promoted products that appear on it.

 

f)  It is mandatory that the participant confirms they have read and accept these terms and conditions, as well as the privacy policy, by marking the boxes enabled for this purpose in the registration form.

 

The entry shall be registered when the participant submits the registration form and is given on-screen confirmation that registration has been successfully completed, and they shall also receive the appropriate acknowledgement of receipt via e-mail.

 

-       Within fifteen (15) working days, data provided by the participant will be check to make sure are correct and that they fully comply with these terms and conditions. UNILEVER shall proceed to send the participant an e-mail with a link to their gift and instructions on how to redeem it on Rewards For All.

Any participants about whom there is well-founded suspicion or proof that they have used false accounts to fraudulently increase their chances of winning a prize shall be automatically eliminated.

Fraudulent entries shall be expressly excluded from taking part. The use of robotic and computerised means to fraudulently increase the number of entries shall be considered particularly fraudulent and result in the participant being immediately disqualified.


6. GIFT


The gift (hereinafter, the “Gift” or “Gift codes”) in this promotion shall consist of 1 experience valued at €20 in the Red de Actividades on the Rewards For All platform. The conditions of the gift are available in section 8 of these terms and conditions.

The type of experiences that the participant may find on the Rewards For All platform shall be free experiences: in-person and/or online activities, which do not require payment from the participant.

Furthermore, the participant may find offers in the form of discounts and/or 2X1, which shall require partial payment from the participant in order to gain access to these.

The type of each of the experiences shall be defined in their description, or failing that, it shall be indicated by the collaborating establishment itself which the participant selects when making the booking.

 

7. MECHANICS FOR USING THE GIFT

 

Once the link with their gift has been received in accordance with section 5 above, and during the use period, the participant must follow the steps below to redeem it on Rewards For All and use their experience:

1.  Visit the Rewards For All platform using the link received.

2.  Choose one (1) available experience from the various categories on Rewards For All.

3.  Make a booking with the selected establishment at least two (2) weeks in advance by following the instructions given in the description of the offer. Alternatively, contact the collaborating establishment directly using the phone number and/or e-mail address found next to the selected offer.

4.  Download the booking voucher associated with the establishment and selected experience.

 

5. Go* to the establishment on the day and at the time agreed on, and show the printed booking voucher together with an official identification document (National Identity Document (DNI), Foreigners’ Identity Document (NIE) or passport).

 

(*) Except for online experiences, in which the instructions given by the collaborating establishment and/or the instructions provided in the description of the offer must be followed in order to gain access to the experience.

In the event that the participant has two (2) or more experiences, they must repeat the aforementioned mechanics by following the above steps for every gift code in order to use each one of them.

Participants may visit the Rewards For All platform as many times as they wish to look at the available experiences throughout the use period. The gift shall only be cancelled when the participant has redeemed it or on 30/05/2025, whichever happens first.

 

8. SPECIFIC CONDITIONS FOR THE USE OF EXPERIENCES AND/OR GIFTS AVAILABLE ON THE REWARDS FOR ALL PLATFORM

 

The use of experiences is limited to one (1) per person, per collaborating establishment and per chain of establishments, so if a participant has access to two (2) or more experiences, with one (1) or more vouchers, they must select different establishments and/or chains of establishments to use their experiences.

All experiences posted on the Rewards For All platform, unless expressly stipulated otherwise in the description of the offer, are for one (1) person and must be used individually. Any bookings in groups or with partners in the same establishment or chain of establishments with two (2) or more booking vouchers are expressly excluded from this promotion. In the event that the participant wishes to use an experience in a group or with a partner, they must pay the collaborating centre the appropriate booking rate for their companions (a group of individuals may not go to a group activity using more than one voucher for said booking).

For the purpose of this promotion, a chain of establishments is understood to be collaborating establishments which, under the same trade name, are found in different locations.

Collaborating establishments may accept no more than one (1) Rewards For All voucher per day, therefore it shall not be possible to redeem two (2) or more vouchers in the same collaborating establishment, regardless of whether the holders of these vouchers are linked to one another or not.

The access, use and benefit of the Rewards For All platform is solely and exclusively aimed at natural persons aged 18 years or over with legal residence in Spain. Any persons aged under 18 years are expressly prohibited from visiting and using said platform, and third parties are also forbidden from entering any personal data concerning the aforementioned.

Collaborating establishments reserve the right to stop any participants who have benefited from an experience in a previous promotion or offer, and/or are already registered as customers in said establishment, from gaining access to the experience.

Collaborating establishments reserve the right to stop any participants who fail to meet the medical, physical, health or any other requirements which, at the discretion of the collaborating establishment, do not allow the experience to be used with full safety guarantees, from gaining access to the experience and also to cancel this once the booking has been made.

If due to any circumstance unconnected with the participant or attributable to the collaborating establishment, they are unable to use their experience, the participant must get in touch using the means stated in section 15 of these terms and conditions as soon as possible, and in any case within the use period.

Without exception, the experience must be used within the use period stated on the voucher and the booking must be made with the collaborating establishment at least two (2) weeks in advance by following the instructions given next to the offer. Alternatively, the collaborating centre should be contacted directly using the means of contact found next to the selected offer.

The availability of experiences is subject to promotional availability and to the availability and conditions of the collaborating centre and/or establishments, which may be limited or non-existent in certain time slots, on some days or at specific times of the year, and particularly towards the end of use periods. The participant must therefore book, when required, as soon as possible and in any case at least two (2) weeks in advance. However, availability for a certain place or date cannot be guaranteed until the booking is made and confirmation is received from the collaborating establishment or centre, irrespective of how far in advance the booking is made.

The use of experiences is subject to acceptance and fulfilment of the Rewards For All general conditions available at www.tuplanazo.com/rewardsforall and to the specific conditions of each collaborating establishment.

Not all experiences and/or categories are available in every province.

Both gift codes and booking vouchers are personal and non-transferable, and may only be used one (1) time by the participant who has obtained them. The data of the booking holder must match the data registered by the participant on the Rewards For All

Just downloading the booking voucher does not mean that a booking has been made, nor shall it give the participant the right to use the experience, unless they have previously made the booking with the collaborating establishment by following the booking instructions given next to the chosen offer. Alternatively, the participant may contact the selected establishment using the phone number and/or e-mail address found on the Rewards For All

The range of experiences and collaborating establishments in this promotion is subject to possible regular changes throughout the use period. The participant must consult the updated list of collaborating establishments and the offer description on the Rewards For All platform when making the booking and downloading their booking voucher.

Any complaints lodged after the use period has come to an end, any related to booking requests made outside the established deadlines, and particularly any which have not been made at least two (2) weeks in advance shall not be dealt with.

Once the booking voucher has been downloaded, it may not be cancelled or changed. The experience must therefore be used on the day and at the time stated and agreed on with the collaborating establishment, during the use period in the collaborating establishment selected by the participant.

After the booking has been made with the collaborating establishment, it may not be cancelled or changed. However, in the event that the participant is unable to go on the day and at the time agreed on for duly justified reasons, they may ask the collaborating establishment to change the date, provided that this request is made in due time and proper form, pursuant to the change and cancellation policy of the establishment concerned.

If the participant does not appear in the collaborating establishment on the day and at the time booked and agreed on, the experience shall be considered used and the participant shall lose their right to use the experience and to receive any kind of compensation for this reason.

Any torn, scraped, manipulated, damaged or photocopied vouchers shall not be accepted. Only the original booking voucher may be presented and delivered to the collaborating establishment to be deemed valid, and the aforementioned may use a computer system to verify that it is authentic and has not been used before.


9. GENERAL CONDITIONS OF THE PROMOTION


The end consumer may take part as many times as they wish, provided that they comply with the promotional mechanics described in section 5 of these terms and conditions.

Any proofs of payment with bank cards, order forms, delivery notes, handwritten documents or any other documents different from the original till receipt or purchase invoice shall not be considered valid for entry in the promotion. In addition, photographs of the products purchased that are blurred or in which it is not possible to see the promoted products clearly, and where it is not easy to see the batch number of the product either shall not be considered valid.

Any gift receipts that do not specify the date, place of purchase or description of the product shall not be accepted.

Any entries that include proofs of purchase or photographs that have been registered before, are illegible in part or in full, as well as any that show signs of having been manipulated or that do not contain all the information described in section 9 of these terms and conditions shall be rejected and therefore excluded from the promotion.

UNILEVER does not accept any responsibility for incidents caused by the participant entering incorrect data in the registration form, failures regarding access to the various web pages or for sending entry replies via e-mail. The participant shall therefore be responsible for asking UNILEVER for any communication that has not been received within the established deadlines, particularly those stipulated in section 5, section 2 and section 7 of these terms and conditions.

In order to ensure the veracity of the entry, UNILEVER may ask the participant for an official document to prove their identity and/or address, as well as the invoice, proof of purchase or any other additional document to prove the purchase of the promoted product.

Participants must receive the gift in the kind indicated and under no circumstances shall it be possible to exchange this for its economic value in cash. The gift may not be subject to any exchange, change, compensation or transfer at the winners’ request.

Selling or marketing of the aforementioned gifts is prohibited.

UNILEVER reserves the right to exchange the gift for one of equal or greater value.

UNILEVER reserves the right to take legal action against any persons who carry out any kind of activity that is likely to be considered manipulation or falsification of entry.

In the event that the winners renounce the gift, this shall not give them any right to compensation.

If the lucky winner dies before accepting the prize, this shall be given to the substitute chosen for this purpose.

UNILEVER is not responsible for any possible loss, damage, theft, delay or any other circumstance attributable to third parties that may affect the way in which this Promotion is carried out.

The winners hold UNILEVER and its collaborators harmless from any damage that they may suffer while the gift subject to this promotion is being used.

UNILEVER reserves the right to make changes that it believes are appropriate to these rules at any time, and to take suitable measures to resolve any conflicts or difficulties that may arise in the Promotion, provided that these are justified, do not unduly damage the Participants in the Promotion and are duly communicated.

In some specific points of sale, it is possible that both promoted products in general and any of their specific references may not be available on a permanent or temporary basis. UNILEVER is not responsible for any inability to find the promoted products or any of their references in the specific points of sale. Entry in the promotion entails full acceptance of these rules.

No employee of the UNILEVER group or first-degree relatives of the aforementioned shall be allowed to take part. Advertising and promotion agencies, or suppliers of either organisation that are related to the promotion shall not be allowed to take part either.

Renunciation of the gift shall not give any right to compensation.

Effective presentation of the prize shall be conditional on the winner fulfilling the conditions stipulated in these rules and to the veracity of the data given to UNILEVER by the winner.

The identity of the winner shall exclusively be proven by means of official documents (National Identity Document (DNI), passport or other identification document).

UNILEVER is not responsible for any use that the lucky winner may make of the prize.

UNILEVER is not responsible for any services that third parties must provide on the occasion of this promotion.

UNILEVER is not responsible for any failures or incidents in the telecommunications systems that prevent the entry web page from being accessed or working as normal.

UNILEVER reserves the right to deregister any person who is misusing the promotion, or who carries out any action that is fraudulent or damages other participants. In the event that UNILEVER or any company that is professionally linked to this promotion detects any anomaly or suspects that a participant is preventing the promotion from being carried out as normal, illegally changing their registrations by means of any technical or computerised procedure, or carrying out any fraudulent activities that contravene the transparency of the aforementioned, UNILEVER reserves the right to deregister any participants who have directly or indirectly benefited from this type of fraudulent activity, as well as to withdraw their gift automatically and without any kind of explanation. UNILEVER may also exercise any applicable civil or criminal action.

In this respect, UNILEVER states to have enabled suitable mechanisms and technological support to detect any possible fraudulent, anomalous or malicious activity that intends to disrupt normal entry in this promotion.

UNILEVER reserves the right to take legal action against any persons who carry out any kind of activity that is likely to be considered manipulation or falsification of the promotion.

UNILEVER does not accept any responsibility for damages of any kind that may be caused by the temporary lack of availability or continuity of the running of services included in the promotion, by users defrauding the way in which these services may be used and, in particular, although not exclusively, by failures regarding access to the various web pages or sending entry replies online, or telephone communications enabled for this purpose.

The period for complaints ends 15 calendar days after the promotion has finished.

The winner may be asked for a written document accepting all the terms and conditions of the promotion.

UNILEVER reserves the right to postpone, extend or make any change to this promotion, giving notice of this far enough in advance. If due to any circumstance, the prizewinner is not able or does not wish to accept the prize, or renounces it, UNILEVER shall proceed to designate the runner-up. In the event that the other runners-up, in turn, do not accept or renounce the prize, this may be declared void.

Any lawsuit that may arise in relation to this promotion shall be subject to the Courts and Tribunals that may be applicable by law. 

Unilever España, S.A. reserves the right to change, when necessary, the conditions of this promotion for other similar ones.

 

10.  DISQUALIFICATION OF ENTRIES

 

Entries shall be rejected if they do not follow, or inconsistently follow, the steps of the mechanics stated in section 5 above, if they exceed the limits appearing in section 9 or if they fail to meet the requirements and conditions stipulated in these terms and conditions. In these cases, the participant shall lose the right to use the gift and/or any kind of compensation.

 Likewise, any persons who make illegitimate use of the entry, receiving help and/or an advantage to manipulate it, shall be disqualified. Any entries with incomplete, manipulated or false information shall also be rejected.

Entries received outside the deadlines established in these terms and conditions shall be rejected.

UNILEVER reserves the right to exclude any persons using false purchasing or entry methods from the campaign.

 

11. DATA PROTECTION


Use of data

The personal data of the participants in this promotion shall be subject to processing by UNILEVER ESPAÑA, S.A. for the following purposes:

Processing of personal data is required in order to manage this promotion. Refusal to provide these shall therefore result in the promotion not being entered or renunciation of the prizes won.

Data shall be processed during the transfer period stipulated in clause 10.

As long as the participant is asked for, and provides, an e-mail address, mobile phone number or other means of electronic communication, the participant expressly authorises said means to be used preferably as a communication channel or channel to achieve all or any one of the purposes that have been indicated previously.

In order to exercise their rights of access, rectification, erasure, objection or restriction of processing, as well as request the portability of their data, the participant may write to the postal address or e-mail address indicated above, specifying “Data Protection – Unilever YOUR BIG SUMMER PLAN" in the subject and indicating the right that they wish to exercise.

Any participant who does not wish to receive marketing messages may also indicate this by activating the unsubscribe mechanisms that will appear in the various marketing messages sent.

UNILEVER informs participants of their right to lodge a complaint with the competent Data Protection Supervisory Authority whenever they believe that the processing of their personal data infringes the applicable data protection regulations.

12. TAXATION


The gift shall be subject to the appropriate income tax deducted or paid at source, chargeable to UNILEVER, which undertakes to provide the appropriate certificate concerning income tax deducted or paid at source in due course, where required by law.

The gift, paid in kind, shall be subject to income tax paid at source and shall be calculated by applying 19% to the result of increasing the acquisition value or cost for the payer by 20%, as provided for in Article 105 of the Income Tax Regulations. If as a result of increasing the acquisition value of the gift by 20% or if the cost borne by the payer does not exceed 300 euros, the gift shall not be subject to income tax paid at source. Income tax paid at source shall be assumed by UNILEVER and paid to the Treasury, and UNILEVER must include this in the return concerning income tax deducted or paid at source, which it must submit using model 111.


13. IMAGE RIGHTS


Winners authorise the organising company to reproduce, use and disseminate their full name and image in any advertising and/or promotional activity related to this promotion, using any means, including the internet, to post photos of the winners on the website. These activities shall not confer any right to remuneration or benefit on the winners whatsoever, except for presentation of the prize won in accordance with these rules.


14.     ACCEPTANCE OF THESE TERMS AND CONDITIONS


Entry in the promotion entails express and unreserved acceptance of these terms and conditions, which shall be available to any interested party:

●        At the Agency offices.
